"supporting not punish those who burns flag" is different with "supporting burning flags". I believe majority won't support burning flags, but if you ask if somebody should be put in jail for burning flags, I think most American would say NO!
The judge cannot just overthrow anything without any support of other existing laws, which has already been established as the reflection of people's will. People sometimes have conflicting wishes, but they are not aware of the confliction. This is different with simply put together something doesn't reflect 民意, or using something that doesn't reflect 民意 to overthrow something reflect 民意 ...
