网上舆论开展对柴玲的起诉，很好，是反思的一种形式。中国人民过去百年
受一小撮极端分子的摆布太多了，这是民族苦难的最根本根源。现在应该清
算一下。
芦老摘录一些柴玲的话，揭露了一些学领的动机，目的，手段，澄清了事实。
很有必要。但批评者暴露了一些糊涂认识，俺择要批驳几句。
1。“柴的作用只是很多因素之一，不能因此治罪。”
这显然会把讨论引入歧途。任何事件的原因都是复杂的，但是不能因为因素
的众多来为罪犯脱罪。少女走夜路，当晚没月亮，都是强奸的因素之一，但
是却不能因此为强奸犯脱罪。只要柴玲的决定对於军民死伤起到重要的作用，
就构成判刑理由；
2。“言论不能当作罪证”
这是错误的。俺下面给出美国，加拿大，新加坡三国法律为例，说明一定言
论本身，只要证实确实说过，就可以定罪：
“发表，编辑，印刷，任何具有暴乱倾向的言论，或者造谣，倡言暴乱，煽
动他人叛国，分裂，或者颠覆，用暴力颠覆或者毁灭政府。初犯判三年，其
后每次五年，法庭可以决定终身监禁。”(全面材料附后)
在美国有一种罪叫‘仇恨罪’，有些人对少数民族叫嚣一些种族口号，这也
能入罪。柴玲如果设计了让别人流血，以实现某种政治企图，而实际也实现
了这种设计，那就有罪嫌。应该依法追究。
3。“柴玲年纪小，应该原谅”
俺不清楚她当年是否成年。如果未成年，可以从轻处罚。但是一旦成年，就
不得不用成年人的法律了。即使是未成年，也不等於不惩罚。俺看电视上一
个美国的中学生放枪杀掉一些同学和老师，就判了无期徒刑。

1。煽动暴乱罪(美加辛三国综合)
发表，编辑，印刷，任何具有暴乱倾向的言论，或者造谣，倡言暴乱，煽动
他人叛国，分裂，或者颠覆，用暴力颠覆或者毁灭政府。初犯判三年，其后
每次五年，法庭可以决定终身监禁。
2。非法结社罪(美国)
组织任何倡言以暴力推翻或者破坏美国政府的社团。在明白其宗旨之后参加
此类组织，得判7年徒刑，罚款无上限。

(s 3-4 of Sedition Act - 3 years for first offence, 5 years for subsequent ones and / or fine) Speak seditious words, publish seditious libel or is a party to seditious conspiracy.
2。(7 years and unlimited fine) USA
Organize any society which advocates the overthrow or destruction of any government in the US by force or violence; become members of such society knowing its purposes.
(18 USCS ”2385 - 20 years and / or fine)
Singapore
Managing or being a member of an unlawful society (i.e. an unregistered society. A society shall be refused registration if its registration would be contrary to the national interest)
(s 14 of the Societies Act - 5 years or 3 years and / or $3,000)
