Under the U.S. constitution, the judicial branch is not under the Congress. The Supreme Court didn’t acquire the power to interpret the constitution because the legislature granted it. The Supreme Court just declared this power for itself. The other two branches didn’t challenge it because the court has always been the rightful place to interpret laws. That is the primary function of the court, to interpret and apply laws.

All branches of the government operates under the constitution, not above it. So what did you mean when you said the national assembly should set up a committee to interpret the constitution or the national assembly should grant the supreme court to interpret the constitution?
