Smith Act of 1940是美国在二战期间为了战争期间的国家安全立的法，另有宪法第一修正案保护
言论自由。在具体的判定上，以案例形式( 在 三 Ｋ 党 人 有 关 的 Brandenburg
v. Ohio 395 U.S. 444 1969 一 案 中)， 确 立 了 现 在 美 国 法 院 普 遍 应
用 的 Clear and Present Danger Test 的 原 则 ， 这 原 则 包 含 了两 点
：
一 、 言 论 是 鼓 吹 具 体 的 违 法 行 为 ， 并 不 是 鼓 吹 抽 象 理
论 。
二 、 鼓 吹 的 违 法 行 为 ， 在 言 论 发 表 后 ， 确 实 会 迫 切 地
使 违 法 行 为 出现 。
中国现在没有类似“宪法第一修正案”的条款保护言论自由，也没有Clear and Present
Danger Test 的 原 则。这些我们都无能为力，一时难以达到。但是，刑法第一百
零五条至少应达到Smith Act of 1940的水平，也就是“以武力和暴力推翻破坏国家
政权”。如果没有“以武力和暴力”的限制，Smith Act of 1940比中国刑法105条
还“恶”。 下面是Smith Act of 1940前两段翻译，法律用语可能翻得不妥：
“Whoever knowingly or willfully advocates, abets, advises, or teaches the
duty, necessity, desirability, or propriety of overthrowing or destroying
the government of the United States or the government of any State, Territory,
District or Possession thereof, or the government of any political subdivision
therein, by force or violence, or by the assassination of any officer of
any such government; or
Whoever, with intent to cause the overthrow or destruction of any such government,
prints, publishes, edits, issues, circulates, sells, distributes, or publicly
displays any written or printed matter advocating, advising, or teaching
the duty, necessity, desirability, or propriety of overthrowing or destroying
any government in the United States by force or violence, or attempts to
do so; or”
任何人倡导、鼓动、劝说、教唆以武力和暴力推翻破坏国家、州、地区、特区、政
治分区政权的责任、必要性、正当性，或
任何人以推翻破坏上述政权目的，用印刷、出版、汇集、出版物、传播、销售、散
布、或当众显示任何文字和印刷品，来倡导、鼓动、劝说、教唆以武力和暴力推翻
破坏国家任何级别政权的责任、必要性、正当性，或企图如此做，
